Rich has over fourteen years’ experience representing clients in a range of business litigation matters in both state and federal courts and in arbitrations.  He regularly advises clients on strategies to avoid litigation and/or reduce its cost.  Prior to joining NBP, Rich was a partner at Foley Hoag LLP, where he focused his practice on complex commercial litigation, product liability defense, bankruptcy and employment related matters.

Performance

  • Obtained emergency relief order following evidentiary hearing requiring Polish coding company to turn over IP and domain access to US-based development company and to company from soliciting development company’s clients.
  • Secured full defense verdict in favor of life insurance broker following two-week jury trial in Massachusetts Superior Court, defeating multimillion dollar claims for misrepresentation and aiding and abetting breach of fiduciary duty.
  • Key member of trial team that obtained judgment in favor of foreign sovereign dismissing a claim to collect over $1 billion from alleged fake bonds following six-week federal court trial.
  • Obtained arbitration award upholding right of licensor of high-tech incubator space to terminate licensee’s license.
  • Obtained favorable settlement for prescription data therapeutics developer in dispute with licensor, resolving federal court litigation.
  • Negotiated significant revisions to contracts with multiple Massachusetts municipalities on behalf of recycling services provider following global collapse of recyclables market, avoiding litigation and bankruptcy.
  • Part of team that served as national counsel to plumbing hardware manufacturer, successfully defending dozens of product liability cases in across the country.
  • Obtained award from CPR-appointed arbitrator following evidentiary hearing denying Canadian solar panel manufacturer’s claim against New England-based solar project developer for purchase of damaged panels.
  • Obtained favorable settlement for Spanish consulting firm in preference action brought as part of mega-bankruptcy in New York.
  • Represented physicians’ association as largest creditor in involuntary bankruptcy of healthcare management services provider, initiating bankruptcy and working with trustee and his counsel to obtain significant dividends for creditors.
  • Advised dozens of financial advisors on non-compete and non-solicit restrictions in connection with transition to new employer, avoiding or quickly resolving litigation in all cases.
  • Defeated motion to dismiss and then obtained favorable settlement for Massachusetts-based pharmaceutical company following former employee’s breach of agreement not to solicit co-workers.

Credentials

Rich graduated magna cum laude from Boston University in 2000 and cum laude from Boston College Law School in 2007.  In law school, he was an editor of the Uniform Commercial Code Reporter-Digest.  From 2013-14, Rich served as a Special Assistant District Attorney for Norfolk County, prosecuting a variety of crimes in Quincy District Court.  Prior to and during law school, Rich was an account manager for an international public relations firm developing media strategies and analyst relations programs for technology companies. 

Professional Activities/Affiliations

Rich is admitted to practice in the Commonwealth of Massachusetts, as well as the United States District Court for Massachusetts and the United States Courts of Appeals for the First, Sixth, Eleventh and District of Columbia Circuits.  He is a member of the Boston Bar Association, where he is an alumnus of the Public Interest Leadership Program (PILP), served on the steering committees for the Recently Elected Partner Forum and the John & Abigail Adams Benefit, and chaired the PILP Selection and Recruitment Committee.  Throughout his career, Rich has represented numerous clients pro bono in domestic violence, housing, bankruptcy, special education, and immigration matters and, most recently, was named to the Massachusetts Supreme Judicial Court’s 2020 Pro Bono Individual Attorney High Honor Roll.
