NBP recently served as lead counsel to the audit committee of a publicly traded biotech company facing whistle-blower allegations of accounting fraud and product recall issues. We conducted an independent investigation involving the review of millions of pages of documents , interviewed key witnesses — from scientists to the CEO — and issued an independent report to the committee.
In 2015, we were engaged by the Commonwealth of Massachusetts to perform an internal review and audit of the State’s medical marijuana program. This project included a systematic review of the regulations, and in-depth interviews with scores of industry insiders concerning, among other areas, the flow of funds into and out of proposed medical marijuana facilities, analysis of background check and financial information, interfacing with several state agencies, and successfully defending over a dozen lawsuits on behalf of the Commonwealth of Massachusetts. This was a highly scrutinized engagement that required a delicate balance between maintaining confidentiality, and addressing a high level of public interest that comes with government investigations.
We also have served as lead outside counsel to a Massachusetts defense contractor ensnared in United States Department of Justice and parallel State Department investigations concerning alleged violations of the Arms Export Control Act. Serving as lead counsel, we reviewed and analyzed millions of documents, conducted witness interviews and counseled the company on an improved and enhanced compliance program. We persuaded the Justice Department not to prosecute the Company.
In addition, we conducted an internal audit for a transportation company of all open investigations of catastrophic incidents and developed the go-to manual concerning all facets of accident investigation, including protocols for the collection of evidence and witness interviews, protection of privileges, and reporting requirements to state and federal authorities.
