Antitrust

NBP represents a group of over 125 dairy farmers located throughout Massachusetts, New York, Pennsylvania, Maryland and Vermont advancing antitrust claims against a national dairy cooperative and a milk marketing association for their unlawful creation of monopoly and monopsony power in the milk distribution system.  The farmers allege that defendants violated federal antitrust laws by, among other things, tying up access to milk bottling plants through unlawful exclusive supply agreements and then using that power to force independent farms to join their cooperative and marketing association, thereby suppressing the price of milk.  The dairy farmers seek recovery of millions of dollars in damages and injunctive relief.
