Will is an accomplished trial lawyer with decades of experience litigating matters throughout the United States.  He has represented high profile clients in virtually every industry, from trust and estate matters to intricate financial litigation.  Will specializes in the representation of institutional and individual investors victimized by Ponzi schemes and other investment frauds, including those involving hedge funds, SPACs, REITS, equity investment in emerging industries (including crypto) and every other business combination.  He has recovered hundreds of millions of dollars for his clients, and helped them navigate the myriad issues that arise, including coordination with the US Attorney’s Office, the FBI, the SEC, FINRA, and Court appointed Receivers.  Will takes a holistic approach and advises clients on reputational concerns, press inquiries and investor relations.  In addition, Will also represents top ranked athletes, especially in professional tennis, where he has handled cases involving internal investigations, failed drug tests, and disputes with corporate sponsors.  In all matters, Will’s philosophy is one of positive engagement, to build relationships and resolve matters efficiently and effectively, through mediation, arbitration, or trial.  He is a trusted advisor to scores of senior executives in the business world.

Performance

  • Currently representing over 100 investors and $200+ million in losses suffered in a fraudulent hedge fund allegedly engaged in OTC derivative trades.
  • Advisor to major investors in both collapsed crypto firm FTX as well as former President Trump SPAC DWAC (now DJT).
  • Lead counsel representing 50 investors and $60+ million net investment in recovery effort of collapsed New York based hedge fund specializing in direct lending.
  • Lead Counsel representing 40+ investors and $30+ net investment in recovery effort of collapsed Pennsylvania based hedge fund that purported to be engaged in exotic options trading strategies.
  • Lead Counsel representing a cryptocurrency Fund of Funds seeking recovery of assets stolen by a fund manager that allegedly used an algorithm to exploit price differences in certain international markets.
  • Lead counsel in a series of litigations surrounding the eight-figure theft of funds ear-marked for a Facebook pre-IPO stock transaction, resulting in fulsome recovery.
  • Lead counsel to a prominent Massachusetts family office, prosecuting multiple actions against parties culpable for the theft of $58 million in trust funds resulting in fulsome recovery.
  • Served as a Special Assistant Attorneys General defending the Commonwealth in multiple cases concerning the recently enacted Medical Marijuana law.
  • Prosecuted multiple actions for 60 victims of a Miami-based $1 billion Ponzi scheme, towards nearly a 100% gross recovery.
  • Represented one of two co-trustees locked in a battle over control of $20 million in trust assets, exacerbated by a deeply divided cadre of beneficiaries.
  • Defended an ATP professional in the first proceeding brought by the Integrity Unit to investigate gambling allegations.
  • Initiated a derivative action to re-allocate of over $290 million in sale proceeds as between two competing groups of investment funds.
  • Tried the first case of a top professional athlete the world’s former number 2 ranked tennis player claiming that a supplement manufacturer was responsible for a positive steroid test caused by its contaminated product.
  • Served as counsel to a Czech Republic publicly traded company, in a Federal Court District of Massachusetts jury trial involving competing claims of intentional interference with contractual relations, as reported by the Wall Street Journal.
  • Successfully prosecuted claims in Massachusetts state court on behalf of a Cambridge-based health care company for breach of contract and violation of the Massachusetts unfair business statute, culminating in a substantial jury verdict.
  • Represented an international entertainment company in a series of complex work-outs, including litigation, to restructure or terminate leasehold interests, resulting in a corporate savings of over $15 million.
  • Twice won one of the five largest jury verdicts in Massachusetts, as recognized by Massachusetts Lawyers Weekly. In 2002, Will was trial counsel for three of five plaintiffs in the action Gail Cahaly et al v. Benistar Property Exchange, et al.  The four-week trial resulted in a $9.2 million unanimous jury verdict in which Merrill Lynch was found liable for aiding and abetting one of its clients in a Ponzi scheme. 
  • In 2003, Will served as lead trial counsel in Brewster Wallcoverings v. Blue Mountain Wallcoverings, where the jury returned a verdict of $6.4 million for breach of contract and fraud resulting from the defendant’s bad faith repudiation of a distribution agreement.

 

Professional Activities/Affiliations

Will is a 1988 cum laude graduate of Boston University and a 1991 cum laude graduate of Syracuse University College of Law.  He started his practice at Brown Rudnick Freed & Gesmer, before joining Kirkpatrick & Lockhart.

 

Credentials

Will is admitted to the courts of Massachusetts, United States District Court for the District of Massachusetts, and the First Circuit Court of Appeals.  And Will has been admitted pro hac vice in more than a dozen different states.  He has appeared in FINRA and the American Arbitration Association proceedings in major cities throughout the United States.
