NBP has extensive experience representing public and private clients in healthcare matters. NBP attorneys have participated in and have advised clients regarding the recent healthcare laws and regulations, including in the drafting of the Commonwealth’s landmark healthcare cost containment legislation, known as Chapter 224 of the Acts of 2012.  We can advise health care provider systems on how to meet the state’s reporting requirements on financial performance and cost trends, and to negotiate with state agencies on behalf of providers on issues such as document requests and performance improvement plans.  NBP can also assist clients in navigating the state’s determination of need process, which lays out the steps required before a provider can move forward with a merger, acquisition or expansion.

NBP’s healthcare experience includes representing clients in various internal investigations, employment matters and litigation.  For example, NBP successfully represented a medical device company in a variety of employment and commercial disputes, and recovered millions of dollars on behalf of a second opinion telemedicine company involving claims for unpaid services in connection with clinical trials.

NBP also was retained by the Commonwealth of Massachusetts to perform an internal review of the State’s medical marijuana program and to represent the Commonwealth in over a dozen lawsuits challenging the process by which applicants were approved to operate dispensaries.  NBP’s extensive government investigation practice, coupled with its vast litigation experience and health care subject matter knowledge, brought about successful decisions in these suits.
